Customer Conduct

Customer is solely responsible for the server use and marketing ad content through the Service. Customer use of the Service is subject to all applicable local, state, country, and international laws and regulations.

Illegal Usage

OBizTek.com hosting servers or any other services may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Adult Content

Due to special system and network requirements of adult oriented sites, pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

Banned Scripts / Programmes

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

Abuse/Spam/Bulk Email Policy

Spamming, or the sending of unsolicited email (any mail for which the recipient has not asked for) from eWebIndia server, promoting a web site hosted by eWebIndia  by spamming from some other source or using an email address or domain that is maintained on OBizTek.com servers as reference is STRICTLY prohibited. We will be the sole arbiter as to what constitutes a violation of this provision and can terminate/suspend any account without prior notice.

Server Resource Abuse

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource used to an acceptable level. OBizTek.com shall be the sole arbiter of what is considered to be a high server usage level. Any hosting account deemed to be adversely affecting the server performance or the network integrity will be shut down without prior notice.

Backup

OBizTek.com is not responsible for backups for MySql databases. Subscriber acknowledges that they will backup their own databases from the backup utility provided from their control panel. We performs weekly backups on all servers to ensure critical files are never lost but that does mean that data backup security is only our responsibility.

Limitation of Liability

OBizTek.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from India Internets servers going off-line or being unavailable for any reason whatsoever. Furthermore, OBizTek.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from any of our servers. All damages shall be limited to the immediate termination of service.

Refusal Of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion. All disputes are subject to Nashik Jurisdiction.
